You're correct if it were truly free market, but they have bought the ...

...process in virtually every city. Look at campaign contribution lists for most city offices and you'll see the candidates are generously (and legally) supported by real estate and development people. Zoning commissions are almost always someone from the industry. Developers do take risks, but often the taxpayers suffer when they lose.
